On the implementation of Anti-Bribery and Anti-Corruption Policies and 
Procedures within Kazakhmys Holding LLC in 2019

 Anti-Bribery and Anti-Corruption Policies and Procedures have been implemented within Kazakhmys Group companies pursuant to the approved Action Plan for 2019.  

The following actions were undertaken in 2019.  

Updating of in-house Anti-Bribery and Anti-Corruption acts.  

An updated version of Anti-Bribery and Anti-Corruption Code of Kazakhmys Group was approved by Resolution No X/70-пр of the Board of Directors, Kazakhmys Holding, dated April 10, 2019 based on the amendments made in 2018 to Regulations for Reconciliation/Approval of Counterparties Refusing to Follow Kazakhmys Group Anti-Corruption Policies; Regulations for Conflict of Interests Management; Regulations for the Structural Units Interaction while responding to Speak Up alert reports/appeals made by legal entities and individuals; Instruction for order of acceptance, registration and scrutiny of Speak Up alert reports/appeals made by legal entities and individuals.   

Major lines of actions within the anti-bribery and anti-corruption 

efforts framework include the following:    

  1. Monitoring, on-site training sessions, implementation of in-house policies and procedures across Kazakhmys Group enterprises.  

 

Pursuant to the approved Action Plan for 2019 the implementation efficiency was monitored for in-house Anti-Bribery and Anti-Corruption policies and procedures. Hands-on assistance was rendered to the following companies of the Group: 

  1. Topar Primary Distribution Electric Power Station LLC, Fuel and Energy Complex;  

  1. Karagaily Concentrator, Concentration and Production Complex; 

  1. Zhezkazgan Concentrators 1, 2, 3, Concentration and Production Complex; 

  1. Balkhash Concentrator, Concentration and Production Complex; 

  1. Nurkazgan Concentrator, Concentration and Production Complex. 

 

 

 

The employees of these companies have completed training aimed at raising awareness on corruption and bribery control, and basic corporate Anti-Corruption policies and procedures. A total of 28 employees were covered by trainings.   

    

2. Speak Up Alert Reporting Service. 

 

Operation of the Speak Up Alert Reporting Service is regulated by Resolution No Х/249-ПР of the Board of Directors Chairman, Kazakhmys Holding dated November 20, 2018 (On the Approval and Introduction of Regulations for the Structural Units Interaction while responding to Speak Up alert reports/appeals made by legal entities and individuals), and by the Instruction for order of acceptance, registration and scrutiny of Speak Up alert reports/appeals made by legal entities and individuals.  

Legal entities, as well as individuals, can report wrongdoing via free-of-charge hotline, with three options available:  

- Phone call (8-800-080-8089); 

- Email (speakup@kazakhmys.kz); 

- Regular mail (Company`s legal address: 12 Lenin St., Karaganda, 100012.)  

 

 A total of 58 Speak Up alert reports/appeals were registered within the covered period (vs 35 in 2018), where:   

55 (vs 32) – reviewed;  

2 (vs 2) – pending;   

1 (vs 0) – re-assigned due to territorial principle.

Out of 55 (vs 32) reports/appeals reviewed:  

20 (vs 10) – satisfied, including 3 (vs 1) repeated; 

28 (vs 13) – dismissed, including 2 (vs 1) repeated; 

6 (vs 5) – clarifications provided; 

1 (vs 4) – official notes issued.   

 

 

  

Out of 58 reports 41 (71%), related to employment relationships and social sphere; 9 (16%) appeals related to actions of the structural subdivisions’ executives, pilferage of commodities and materials and financial offences; 3 (5%) appeals related to procurement (goods, works and services); 5 (8%) appeals related to compliance with Anti-Bribery and Anti-Corruption policies and procedures regarding Conflict of Interests (2 of which a
